On April 28, the new A&E series Accused: Guilty or Innocent? returned with its second episode which explored the case of Danita Thetford Tutt, who was accused in 2016 of attempting to murder her son Colby Tutt. Prosecutors alleged that Tutt, a mother from Cleburne, Texas, injured her son through unnecessary surgery and then withheld food to starve him. Tutt denied those allegations, saying she was only following the recommendations of doctors and hospice workers.
The A&E series explores cases from the perspective of the person accused of a crime, through the trial, their defense and their sentencing, all through the lens of the defense team and the accused and their family. In October 2018, a Tarrant County jury found Tutt guilty of one count of grievous bodily harm to her child and one count of attempted murder for depriving her child of nutrients and food. The jury deliberated for five days before returning its verdict. A few days later, on October 26, 2018, Tutt was sentenced to five years in prison for assaulting a child and a recommended 10-year suspended sentence for attempted murder.
At the time, one of Tutt’s defense attorneys, Terri Moore, said: “She’s devastated. There is no doubt about it. She is heartbroken. She’s flat on her face right now. She’s not someone who’s ever given much thought to spending time in the courthouse. Nobody knows the stress of being in court until it happens to them.” Moore added that the doctors taking care of Colby should take the blame for what happened because they convinced Tutt that her son was terminally ill and dying.
In a statement to Heavy, Moore said: “I still get sick thinking about Danita. She is an innocent young mother. The jury screwed it up,” she adds, adding that she believes the jury was influenced by media coverage of the case, which led to the trial that cast Tutt in a negative light.
Danita remains in prison today and is not eligible for parole until 2021
According to inmate records from the Texas Department of Justice, Tutt is sentenced to prison until October 17, 2023. She is serving her sentence at the William P. Hobby Unit, an all-women prison in Falls County, Texas. Her record says she was denied parole on May 25, 2019 due to the nature of the case, but was eligible for parole on April 18, 2021. According to Danita Tutt’s Facebook page, a family member indicated that she will be released on parole on October 1, 2021. Heavy contacted Tutt’s attorneys to confirm this, but did not hear an immediate response.
In a previous email to Heavy, Moore said: “Danita is a strong woman who is deeply committed to her faith. She uses her faith to show other imprisoned women that they can draw on that faith to give them strength.” She added that an appeal had been made but no decision had been made.
She said, “It’s heartbreaking that she has to be separated from her children and that her son continues to have the same health issues that he [had] before Danita was sentenced.” There are reports online that Tutt’s son has died, however Family members on Facebook have said the reporting is false and Colby Tutt is alive, although he continues to suffer from the same health issues.
