American attorney, Member of the US Senate
Elizabeth MacDonough (born February 16, 1966) is an American attorney and member of the US Senate since 2012. She is the first woman to hold this position.[1][2]
Early life and education[edit]
MacDonough grew up near Washington DC, graduated from Greens Farms Academy in 1984[3] and received her bachelor’s degree from George Washington University in 1988.[1][4]
MacDonough began her career in 1990 as legislative reference clerk at the Senate Library and later as assistant morning business editor for Congressional Record.[1] She left in 1995 to attend Vermont Law School, graduating in 1998 with a JD. While attending law school, MacDonough did internships with Judge Royce C. Lamberth (United States District Court for the District of Columbia) and with the Immigration and Naturalization Service in Burlington, Vermont.[4]
Career [edit]
After graduating, MacDonough worked as a trial attorney for the US Department of Justice handling immigration cases in New Jersey.[1] MacDonough joined the Senate Houseman’s Office as an Assistant Houseman in May 1999 and was promoted to Senior Assistant Houseman in 2002. She advised then-Vice President Al Gore on the procedure for counting the Bush v. Gore ballots.[4]
Upon her appointment as MP in 2012, she was praised by outgoing MP Alan Frumin as “down to earth” and described her personal knowledge of Capitol staff; and by Senator Richard Shelby (R-AL) as “smart, hardworking … and she has integrity.” [1] Senator John Thune (R-SD) said: “She is very rooted in the traditions of the Senate and understands how it is works here” and Sen. Mark Warner (D-VA) said he had “no doubts about their ability to read the rules and make the right decisions.”[7]
During Congress’ 2015 effort to partially repeal the Patient Protection and Affordable Care Act (ACA), MacDonough ruled that the provision that would reverse the Independent Payment Advisory Board would exempt the 2015 package from consideration as a reconciliation bill in the Senate under the Byrd rule ruled out. which requires the transitional laws to be budget effective. Instead of the simple, filibuster-free majority of 51 votes required to pass a reconciliation bill, the 2015 package would require a threshold of 60 votes to pass in the Senate, effectively nullifying the Senate legislation as the Republicans did not do the required votes.[8][9] Senator Ted Cruz (R-TX) commented that MacDonough should be fired or ignored, although since procedural decisions are officially made by the Senate President (in 2015 it was then-Vice President Joe Biden), MacDonough’s firing could have made no difference, and Sen. John Cornyn (R-TX), the senior Texas senator, dismissed Cruz’s comments, saying toppling MacDonough would be “like firing the judge if you disagree with his decision.”[10]
During the passage of the Tax Cuts and Jobs Act of 2017, MacDonough ruled that repealing the Johnson Amendment, which restricts churches’ political speech, could not be included in the bill.[11]
In January 2017, House Speaker Paul Ryan (R-WI) said that MacDonough was the person to “watch” in the Senate, as the Budget Reconciliation would likely again be the tool through which changes to the Affordable Care Act would be passed would .[12][13]
In January 2017, MacDonough ruled that a provision in the Tax Cuts and Employment Act 2017 that would open ANWR area 1002 to oil and gas drilling met the terms of the Byrd Rule in the budget vote.[14]
In 2017, MacDonough read Senator Steve Daines (R-MT), chairing a Senate session, the language of Senate Rule XIX, which Daines carefully repeated while warning Sen. Elizabeth Warren (D-MA) for using statements by Ted Kennedy and Coretta had read Scott King condemned the nomination of Jeff Sessions.[15] The Senate subsequently voted 49 to 43 to uphold Majority Leader Mitch McConnell’s objection that Warren had challenged the nature of Sessions.
In a 2018 inaugural address at her alma mater, Vermont Law School, MacDonough called invoking the “nuclear option” in 2013 and 2017 “a stinging defeat that I didn’t want to take personally.”[18] The 2013 vote eliminated the need for a three-fifths supermajority for Cloture for all executive and judicial nominations except those for the Supreme Court, while the 2017 vote eliminated the need for Supreme Court nominations.
MacDonough attracted attention ahead of Donald Trump’s 2020 impeachment trial for her role in advising Chief Justice John Roberts on parliamentary procedure while presiding over the trial.[18]
MacDonough was praised by Patrick Leahy (D-VT) and former Majority Whip John Cornyn (R-TX), with Leahy saying he was “here with many, many MPs. All were good. But she’s the best,” and Cornyn said that “she’s tough” and “she calls her right in the middle.”[18]
In June 2020, MacDonough presented Senator Josh Hawley (R-MO) with a decision ruling that a vote on the Senator’s decision to leave the WTO was appropriate.[19] However, she reversed herself two weeks later after considering new arguments regarding the schedule requirements of Sen. Chuck Grassley (R-IA) and Sen. Ron Wyden (D-Ore.).[20]
MacDonough speaks publicly only once a year to address the US Senate youth program.[21]
In January 2021, MacDonough and her associates secured Electoral College votes ahead of the 2020 presidential election by moving them to a safe location as rioters swept into the Capitol.[22][23]
In February 2021, it ruled against the $15 minimum wage provision in President Biden’s proposed COVID-19 relief package, which was included in the budget reconciliation under the Byrd Rule.[24]
In April 2021, she ruled that Democrats can pass spending legislation with a simple majority, using a process reserved for budget reconciliation.[25] In the past, this rule was limited to one application per year. But MacDonough decided it could be used multiple times a year if the bill was budget-based.
In September 2021, she opted against including a path to legalization for millions of immigrants in the Democrats’ $3.5 trillion Reconciliation Act, stating that “amending the law to include the path to status (legally permanent resident ) is an enormous and enduring policy change that dwarfs its budgetary impact.”[26]
