Early life and education[edit]
Danny Porush, the son of a doctor, grew up in a Jewish family in Lawrence, Nassau County, New York.[4][5][6] Porush graduated from Lawrence Woodmere Academy.[4] He attended Dickinson College and Boston University, but did not graduate.[4][7] According to New Yorker magazine, Porush then “hopped from job to job, working for and starting a variety of small businesses.”[7]

In the late 1980s, Porush helped Jordan Belfort found Stratton Oakmont, an over-the-counter (OTC) brokerage house in Long Island, New York, of which Belfort was chairman and Porush president.[8] Stratton Oakmont specialized in selling “penny stocks” and underwriting IPOs for small companies including Steve Madden (a childhood friend of Porush),[5] Master Glazier’s Karate International Inc., Dualstar Technologies,[9] Select Media Communications , [9] United Leisure Corporation[9] and Questron Technology.[10] In 1994, Porush assumed the position of Chairman and CEO of Stratton after Belfort was ousted from the industry.[11]
Beginning in 1989, Stratton Oakmont became the subject of numerous disciplinary actions from the National Association of Securities Dealers (NASD) and the Securities and Exchange Commission (SEC).[11][12] Stratton Oakmont was found to be involved in pump-and-dump stock scams, in which the price of stocks was artificially inflated through false and misleading positive statements in order to sell cheaply acquired stock at a higher price. Once the program operators “dumped” their overvalued stocks, the price fell and investors lost their money.[13] In December 1996, the NASD permanently expelled Stratton Oakmont from the school, suspended Porush, and fined him $250,000.[11] The NASD dismissed Porush’s claim that he was just “a figurehead” and named him the seller with the largest single allotment.[11] In its decision to disqualify Porush and his chief dealer Steven P. Sanders, the NASD wrote that “[they] continue to deny responsibility and show no remorse for [their] wrongdoing and would continue to press charges without the bar at ongoing risk.” for the investing public.”[11]
In 1999, following federal indictments, Porush and Belfort pleaded guilty to 10 counts of securities fraud and money laundering.[14] In exchange for reduced sentences, Porush and Belfort cooperated with their colleagues’ federal investigations.[14] Porush was “convicted of insider trading, perjury, conspiracy and money laundering and ordered to pay $200 million in damages.”[15] He was sentenced to four years in prison and Belfort to two years in prison. Porush was released on parole in 2004 after serving 39 months.[2][16]
In 2013, the Stratton Oakmont story as told by Jordan Belfort in his 2007 memoir was adapted into Martin Scorsese’s The Wolf of Wall Street. In the film, Jonah Hill portrays a character named Donnie Azoff, who is loosely based on Porush. Porush has stated that many of the incidents in the film are fictitious.[3] The character’s name was changed during film development after Porush threatened to sue Paramount Pictures if he was portrayed.[17]

After his release from prison in 2004, Porush became involved with a Boca Raton, Fla.-based medical supplies and medical equipment company operating under the names Med-Care Diabetic & Medical Supplies, Christian Diabetics, and The Christian branded health network.[2][18] The company Med-Care was the subject of a congressional hearing on Medicare fraud in April 2013.[19][20] In May 2014, Porush’s involvement in Med-Care was cited as a reason for part of the federal Stop Scams Act of 2014 that would require Medicare providers to disclose their ownership interests.[20][21] According to Med-Care’s attorney, the Centers for Medicare & Medicaid Services had been informed and had previously reviewed and approved Porush’s role with the company.[20]
In 2014, Porush and five other Med-Care employees were named in a whistleblower complaint alleging fraudulent claims by Medicare.[19] The case was initially dismissed by the federal court for lack of concrete evidence.[22] However, the lawsuit was refiled and accepted in federal court when the original whistleblower was joined by two other former Med-Care employees who accused the company of defrauding the federal government.[23] The lawsuit alleged that telemarketers led by Porush made unsolicited calls to citizens and used high-pressure sales tactics to trick them into accepting medical care they may not want or need.[15] On January 14, 2015, agents from the Federal Bureau of Investigation (FBI), the Florida Fraud Division and local police searched the Boca Raton offices of Med-Care Diabetic & Medical Supplies and removed boxes of files.[24][25] On January 16, 2015, Med-Care’s attorneys filed a motion in court to disqualify the Whileleblowers’ attorneys for professional conflicts of interest.[15]
