Vincent Roy Margera (July 3, 1956[1] – November 15, 2015),[2] commonly known as Don Vito, was an American reality television personality. He was known for his appearances in Viva La Bam, Jackass, Haggard and the CKY series along with his nephew Bam and brother Phil.

Early life[edit]

Margera was born in Chester, Pennsylvania,[1] and raised in Concord Township to Darlene (née Stauffer) and Phillip Margera.[2] He was single and lived in a house formerly owned by his brother in West Chester, Pennsylvania, where he moved in the early 2000s.

Margera rose to prominence after appearing regularly on the MTV television series Viva La Bam, where he was commonly referred to as “Don Vito”, a nickname given to him by his nephew Bam. The nickname referred to his almost incomprehensible speech, reminiscent of Don Vito Corleone from The Godfather, and paid tribute to the Margera family’s Italian heritage. He has previously appeared in sketches and videos with his family, most of which were released as part of the CKY series and some later appeared in Jackass.[3]

As a result of his arrest in 2006, the stunts involving Don Vito were removed from the theatrical and DVD release of Jackass Number Two, but some stunts were previewed shortly before his arrest. Because of the allegations, he was temporarily considered persona non grata in the cast.[4]

In early 2007, Margera starred in Redman’s music video “Put It Down,” playing a cop with Donnell Rawlings.[5] On March 20, 2007, Vito and Ryan Dunn starred in a Viva La Bam-like direct-to-DVD film entitled Dunn and Vito’s Rock Tour.[6]

Legal issues[edit]

On August 18, 2006, Margera was arrested at the Colorado Mills Mall in Lakewood, Colorado on suspicion of inappropriately touching two 12-year-old girls. He was released after posting $50,000 bail.[7]

During a preliminary hearing on February 1, 2007, Margera was represented by Pamela Mackey, the same attorney who defended Kobe Bryant in his 2003-2004 sexual assault case.[8] An indictment hearing was held on March 5, 2007, at which Margera pleaded not guilty.

The trial began on October 22 in Golden, Colorado. Margera’s attorney argued that his client had played his “silly, outrageous, and vulgar” television persona for the young teens,[9] portraying Margera as a “benign bungler” and arguing that Margera’s signature arm movement may have been mistaken for breast rubbing.[10]

The jury began deliberating on the afternoon of October 30 [11] and returned on October 31. Margera was found guilty of two counts of sexually assaulting a minor and acquitted of one count.

On December 20, 2007, Margera was sentenced to 10 years of probation in Pennsylvania. He was also ordered not to portray the character of “Don Vito” in any way (appearing on television, writing books, signing autographs) while serving his sentence. He was also ordered to register as a sex offender in Colorado and Pennsylvania, receive a mental health evaluation, and work on his drinking problems.[12]

Health problems and death[edit]

For most of his life, Margera was obese and had difficulty playing sports due to his weight. [citation needed] He also had squint, which left him partially blind in one eye, and alcoholism. [citation needed] According to his nephew, Bam, he also suffered from depression after his conviction.

In October 2015, Margera collapsed at his home in West Chester, Pennsylvania and was rushed to the hospital, where he was in a coma for five days. According to his family, he died of massive organ failure as a result of years of obesity and alcoholism.[13] Despite initial improvement in the weeks leading up to his death, he died of kidney and liver failure on November 15, 2015 at the age of 59.[14]

It’s nothing new that less-than-lovely characters are reviled by those whose names are at the top of the marquee. Moe hit Curly; Seinfeld put Newman in his place. But in “Viva La Bam,” the routine humiliation suffered by his photogenic young nephew at Don Vito, an obese, middle-aged man who appeared to have problems with alcohol and a less-than-gentlemanly view of women, always seemed cruel and unusual . It wasn’t clear that Vincent/Vito really understood what was going on.

In one representative episode – “Destination: Mexico,” which aired in 2005 and doesn’t hold up well – Bam and company travel to the sunny south of the border, leaving Don Vito in snowy Pennsylvania.

The episode ends when, after several embarrassing attempts, Don Vito fails to learn 10 Spanish phrases. In the last minute of the show, Bam tops his uncle off with a sombrero into which he pours salsa. Bam and his crew then dip tortilla chips in the salsa and eat them off Vito’s head.

MTV is no stranger to bad taste. This episode and many others would likely have disappeared among the network’s many “Spring Break” adventures and other questionable programming. But in real life beyond reality TV, Vincent Margera inhabited “Don Vito” all too well. In 2006, he was arrested after allegedly groping three girls – two 12-year-olds and a 14-year-old – at an autograph session in Lakewood, Colorado.

“This man was out of control during this public event,” said District Attorney Jim Stanley. “He was so drunk he wet his pants with those kids.”

Margera’s defense was odd: his attorney argued that her client was merely occupying the ill-behaved Don Vito when he converted.

“Fans came to see the crazy, outrageous, profane uncle,” said Pamela Mackey, Margera’s attorney. “They wanted to be photographed with that. The fans expected to see Don Vito, not Vincent Margera… They may find the behavior vulgar and disgusting, but it was done to amuse, entertain and make laugh.”

An unconvinced jury found Margera guilty of two counts of sexually assaulting a child. As the verdict was read, Margera collapsed in court. His words were terrifying.

“You might as well kill me now!” he cried.

Margera, who could have served six years in prison, faced a somewhat bizarre sentence. He had to register as a sex offender and spend ten years on probation – it was routine. But to avoid jail, a judge ordered Margera “to stop being Don Vito” for a decade.

The victims seem satisfied with the verdict.

“I’m glad we haven’t fallen as a society where touching young girls is entertainment,” said one victim’s grandmother at the time.

Margera appeared to abide by the verdict. Scenes in which he appeared were reportedly cut from a later Jackass film. Between his sentencing and his death, he largely disappeared from press reports.

In comments posted to YouTube in 2012, Bam Margera angrily addressed what appeared to be civil claims against his uncle. There is no point in continuing such actions, Bam said. Vito was broke.

“You know what, lady?” Bam said. “Vito doesn’t have any damn money. He’s got a red Ford Ranger and that’s it.” (Bam Margera was not immediately available for comment.)

However, Vito said he had no regrets.

“He said to me last week that he wanted everyone to know it was a good ride,” sister-in-law April Margera told CNN. “He was enjoying himself and wanted to thank all the fans. He’s been through a lot, especially with the Denver stuff. He wanted everyone to know he never did.”
