Atlanta tech mogul Lance Herndon’s career was booming in the late 1990s, as was the city he lived in. He was even hailed as a rising entrepreneurial star by the Clinton administration.

Herndon’s bright star tragically fell on August 9, 1996. The 41-year-old computer consulting businessman was found beaten to death in his bed at his upscale Roswell home, UPI reported.

Herndon’s mother had called 911 after coworkers told her he hadn’t shown up for work at his home office, investigators said on The Real Murders of Atlanta, which airs Sundays at 8/7c on Oxygen.

“Someone hit his forehead and head with such force that streaks of blood ran down the wall,” said Clint Rucker, a former Fulton County district attorney.

There were no defensive wounds on his hands and little blood was found below the victim’s waist. “Our theory was that the killer climbed onto his naked body and straddled him, punching him in the head and face, causing his death,” Rucker said. This detail later surfaced in court documents.

Investigators took an inventory of the crime scene, which found no signs of forced entry, as well as evidence suggesting the killer had showered before exiting.

Three clocks in the bedroom were unplugged, one of which had frozen at 4:10am. Silver wrappers of chewing gum were found near the garage, Herndon’s prized laptop was missing, and a picture of Herndon’s current girlfriend, Kathy Collins, lay face down on the bed.

Detectives questioned and cleared Collins, who was with another friend when the murder took place. “She seemed very genuine and gave us an alibi,” said Tommy Williams, a former police officer at Roswell PD.

Herndon’s ex-wife Jeannine Price was also considered. “Not only had they recently been divorced, but Lance had a $1 million life insurance policy that listed Jeannine as a beneficiary,” investigators said. Price provided an airtight alibi.

The coroner examined the wounds and, based on a previous case, concluded that an adjustable crescent wrench was used to kill Herndon. Detectives discovered that a 16-inch adjustable crescent wrench was missing from Herndon’s workbench. Shortly before his assassination, he had used the wrench to assemble exercise equipment. That “made it easily accessible to the killer,” Williams said.

Police believed that Herndon’s violent murder may not have been premeditated but a crime of passion.

An interview with Talana Carraway, who once dated the victim and now works for him part-time, helped pinpoint a window of opportunity for the murder. She left work at his home office at 10:30 p.m. on August 9th. After she got home, the two talked on the phone until midnight.

Detectives theorized that the crime took place between 12:00 p.m. and 4:10 a.m., the time frozen on the unplugged bedroom clock. Caraway told officers she had not returned to Herndon’s home and dropped the name Dionne Baugh.

Baugh was attending Georgia State University when she met Herndon on his 41st birthday, which she fought her way to by working at the Metropolitan Atlanta Rapid Transit Authority. They started dating.

“He showered Dionne with a lot of material goodies,” said Rod Stodgill, author of Redbone: Money, Malice and Murder in Atlanta. This included a shiny new Mercedes. Expensive gifts came with a self-image Herndon had cultivated. “He positioned himself in town as a kind of black Jay Gatsby,” Stodgill told NPR.

“What Lance didn’t realize was that Dionne Baugh was probably as much of a gamer as he was,” the crime writer said. “She didn’t tell him she was married.” Because her husband was in Jamaica, she started dating other men. Herndon was among Atlanta’s best catches.

When authorities questioned Baugh, she claimed she and Herndon were “madly in love,” Rucker said. She also said she told her husband, Shaun Nelson, an Air Jamaica pilot who lives in Jamaica, that Herndon was just a mentor.

But the expensive car hinted otherwise, and Nelson knew of the affair. But at the time of the murder he was back in Jamaica and cleared him of any suspicion.

Detectives focused on Baugh, whose relationship with Herndon was tumultuous over seeing other women. A month before the murder, she had come to his house and seen Collins there.

Baugh pounded on the door so aggressively that Herndon called 911. She was arrested and charged with a misdemeanor of criminal trespassing. That criminal case was scheduled to go to trial on the day Herndon’s body was discovered, Rucker said.

Could she have killed him to prevent him from testifying against her in court?

Investigators reviewed Baugh’s account of the night of the murder. She claimed Herndon arrived at her home in Norcross between 9pm and 10:30pm. to lend her his laptop. This timeline contradicted Carraway’s account.

Investigators were convinced that Baugh was behind Herndon’s murder, but a lack of forensic evidence prevented them from connecting her to the crime. Eighteen months passed with no new leads. But in 1998, a tip from Shaun Nelson divorcing Baugh kicked things up a notch.

Nelson claimed that months earlier, in the throes of an argument, he had asked if she had anything to do with Herndon’s death, and Baugh became violent. She threatened to kill him — “just like she did with Lance,” Rucker told producers.

Baugh’s divorce court affidavits about Herndon, which contradicted what she told homicide investigators, came back to haunt her. In this case, she swore that she and Herndon were just friends, a complete 180-degree turn.

Baugh also said that on the night of August 9, she went to Herndon’s home to pick up the laptop. The statement contradicted what she had told homicide detectives two years earlier and brought her to the crime scene.

In 1998, police arrested Baugh for murder and aggravated assault. At her trial, which began in 2001, she faced a life sentence. Prosecutors faced a difficult case based on circumstantial evidence.

“The consistent theme I brought to the judges’ attention is, ‘When did Dionne get the laptop?'” Rucker said. “There really was an opportunity to do it. And that’s when she came into the house at midnight.”

Rucker ran through his account of the murder. After Baugh had sex with Herndon, he fell asleep. She climbed on top of him, straddled his body and brutally beat him to death with the wrench. She grabbed the laptop and walked through the garage area, dropping silver rubber wrappers before escaping.

The jury returned with a guilty verdict. Baugh was sentenced to life imprisonment.

But two years later, Baugh’s conviction was overturned due to a formality regarding detective testimony. In the second proceeding, a mistrial was declared.

Just before the third trial was due to begin, Baugh’s defense team reached out to negotiate a deal. She pleaded guilty to manslaughter and 10 years behind bars. She was released in July 2011.

To learn more about the case, watch The Real Murders of Atlanta, which airs Sundays at 8:7c on Oxygen.

1996 killer of Roswell millionaire out of prison

By Nedra Rhône

The Constitution of the Atlanta Journal

ATLANTA — After a high-profile murder, a commuted life sentence and nearly a decade as fodder for national news outlets, Dionne Baugh is a free woman.

Baugh, 44, served 10 years in prison for the voluntary manslaughter of Roswell millionaire Lance Herndon. She was released in July and is currently serving a 10-year probationary period, said Kristen Stancil, a spokeswoman for the Georgia Department of Corrections.

“I’m glad she’s out and hopefully she’s okay,” said a relative, who asked not to be named. The relative is no longer in touch with Baugh, but could not escape the sensational unfolding of the case from Herndon’s death in 1996 to the publication in 2007 of a true crime book detailing Baugh’s trial from murder conviction to pleading guilty. “I heard about the book but couldn’t read it,” the relative said. “It was too painful.”

In August 1996, Herndon, 41, was found dead at his home in Roswell by his mother. He had been beaten to death with an object that was never found. There were no fingerprints at the scene and no witnesses, and it was more than a year before police arrested Baugh in January 1998. Baugh, who had a husband and young daughter in her native Jamaica, had become Herndon’s mistress after she snagged an invitation to his birthday party.

At the time, Baugh was a petite, trim 29-year-old with a slight accent who was studying finance at Georgia State University while also serving as MARTA’s executive secretary. She owned a home in Norcross and, according to prosecutors, had a penchant for the finer things. Herndon seemed able, and eventually willing, to provide them.

It was Atlanta’s golden era—as host of the Olympics and emerging jewel of the New South—and Herndon, finding his fortune in computer consulting, embodied the city’s spirit. Baugh was reportedly one of several women with whom he shared the perks of his success, including access to credit cards and luxury cars. But after a few months of relationship, while spying on him with another woman, she got into a jealous rage. Herndon filed criminal charges but would not live to see the scheduled court appearance.

In 2001, a jury convicted Baugh of murder, which carried a life sentence. Two years later, the Georgia Supreme Court vacated the conviction on appeal based on improper testimony by a police officer. A second jury deadlocked after a two-week trial. In September 2004, Baugh was scheduled for a third trial but pleaded guilty to the reduced charge of first degree manslaughter.

Baugh remained behind bars, most recently in the medium-security Pulaski State Penitentiary in Hawkinsville, but her story picked up steam again. In 2005, the case was featured in an episode of “Snapped,” Oxygen’s true-crime series about female killers. And in 2007, Redbone: Money, Malice, and Murder in Atlanta by Ron Stodghill (Amistad/HarperCollins, $26) hit bookstores.

Baugh’s relatives hope that if they are released, the families – both Baughs and Herndons – will be able to put the devastating crime behind them.

“She is in my prayers,” the relative said, “along with everyone else involved.”
