Sean Ellis was 19 years old in 1993 when he was arrested for the murder of a Boston police officer after unknowingly being at the scene during an independent police questioning. He was sentenced to life in prison in 1995 and served 22 years in prison before being released on bail in 2015. His fourth scheduled trial was canceled in 2018 over revelations of police corruption in his case and all charges against him were dropped. Netflix’s latest true crime docuseries, Trial 4, follows Ellis as he journeys through America’s corrupt and biased justice system and courts. Prosecutor Phyllis Broker was instrumental in the 1995 conviction and imprisonment of Ellis after his first two trials.

A graduate of Northeastern University School of Law in Boston in the 1970s, Phyllis Broker practiced law both publicly and privately prior to Sean Ellis’ 1995 trial. At the time, Broker was serving as Assistant District Attorney and was appointed chief prosecutor in the state’s case against Ellis and in the separate case against Terry Patterson, his friend with whom he was dating the night of Detective John Mulligan’s death. She argued that the murder was a random crime of opportunity – that the pair had killed the detective sleeping in his car outside of Walgreens when they were about to steal his gun.

“Mulligan died wearing a badge and his gun was stolen because his alleged killers wanted a ‘trophy’ from their victim,” Broker said at Ellis’ third trial. Their theory was that after Sean Ellis bought the diapers he was supposed to buy for his cousin, he and Patterson parked their vehicle on a nearby residential street and walked through the woods back to Walgreens to kill Mulligan. Broker successfully convinced the third-degree jury of Ellis’s guilt, and he was convicted of first-degree murder and armed robbery and sent to Walpole State Penitentiary to begin a life sentence without the possibility of parole.

Broker testified remotely via video at Ellis’ 2014-2015 evidentiary hearings before being released on bail. She was accused of withholding key evidence from the jury in 1995, but testified that she had “no specific recollection” of specific documents in the case and could only describe her “general practice” in dealing with discovery materials. Ellis was released on bail after these hearings revealed corruption and police impropriety in the case, and all charges against him were later dropped.

Phyllis Broker, then a judge, retired from Woburn Circuit Court in Middlesex County, Massachusetts, in 2010, five years before Sean Ellis was released.
