‘Buried by the Bernards’ funeral service investigated amid allegation of remains mix-up
Netflix star R. Bernard Funeral Services is under investigation by the Tennessee Department of Commerce and Insurance after allegations the funeral home mistook the cremated remains of a customer’s loved one.
Memphis resident Donato Velasquez filed a complaint with the state Board of Funeral Directors and Embalmers on July 27.
“Based on the way cremations are conducted, we (the Velasquezs) can affirm that this is the correct ashes, this is the correct ashes,” said Attorney Randall Fishman, representing R. Bernard Funeral Services.
But the Velasquezs aren’t so sure.
Anita Velasquez, Donato’s wife, died on February 18 and, on the recommendation of Crossroads Hospice & Palliative Care, the Bernards’ funeral home collected her body for cremation, the complaint said.
Anita Velasquez was cremated Feb. 23 at the Bernards’ store at 2764 Lamar Avenue, state documents say.
Alfred Velasquez, Donato’s son, arranged for his mother’s ashes to be interred in an urn provided by the family. He received the container of cremains on March 4, the complaint said.
“We never [opened] the urn until her birthday, which was July 19, when we planned to spread her ashes [in Florida],” Donato said in the complaint. “When we opened the urn, we found two pieces of paper in the ashtray. The note contained information that did not belong to my wife.”
Fishman said the undertaker burns each body with a metal disk label to ensure the bodies have the correct labels, and the Bernards inscribed 450 on Anita Velasquez’s disk.
The undertaker presented her ashes in a black box to the Velaquezs, who asked that the cremains be placed in the family urn, Fishman said.

The funeral home said it was unaware of another person’s tag in the urn provided by the Velasquezs and placed their ashes in the container, according to a company response.
“We have informed (Alfred Velasquez) that we accidentally placed someone else’s papers in the urn in error and we sincerely apologize for our error,” the Bernards’ response read.
Fishman said the mix-up was a “very rare mistake in this industry.”
The complaint said the Bernards offered to compensate the family for the incident, but according to the funeral home, Alfred Velasquez asked for a $2,000 refund for the cost of the memorial service.
“We have agreed to reimburse him for these expenses,” the funeral home’s response read. “Following that conversation, another person who did not appear to be a family member took Mr. Alfred Velasquez’s phone, said profanities and hung up.”
Donato Velasquez said in the complaint the family had not yet settled anything.
The State Department said it could not comment on the ongoing investigation.
“The undertaker did everything they could, performed the cremation appropriately, and were able to identify the body by the tag number,” Fishman said.
“I can safely say that (the Velasquezs) have the right ash.”
The Memphis Funeral Home starred in the Netflix series Buried by the Bernards, which followed the home and professional lives of the Bernard family.
The reality show launched in February with eight episodes starring the “quarrelsome but big-hearted Bernards,” as Netflix put it.
The funeral home owner Ryan Bernard started the service in 2017 and runs it alongside his mother Debbie Bernard, his uncle Kevin Miller and his two daughters Deja Bernard and Raegan Bernard, all of whom appear in the Netflix Original.

Even if you haven’t seen the show, you’ve probably heard the premise: It’s a behind-the-scenes look at the lives of the Bernard family — three generations involved in the day-to-day operations of a Memphis funeral home.
Multi-generational, family-owned businesses are common in euthanasia – perhaps more so than in most professions. It’s not nepotism (in most cases); It’s just good business. Families often trust in the stability, consistency and tradition of long-standing family businesses.
R. Bernard Funeral Services isn’t exactly long-standing — owner Ryan Bernard opened it in 2017 to create a legacy his daughters could carry on — and the family hasn’t been involved in end-of-life care in decades.
