When Lynn Aronberg was questioned by attorneys representing wealthy Wellington developer Glenn Straub, questions quickly turned to her short-lived marriage to Palm Beach County District Attorney Dave Aronberg.
Angered by the turn Lynn Aronberg’s testimony took, prosecutors abruptly ended it and later successfully petitioned a judge not to release her affidavits.
Last week, attorneys representing The Palm Beach Post and The Miami Herald went to court to overturn the unusual restriction and others that are preventing the public from learning the details of the racy and potentially far-reaching case.

They claimed that Lynn Aronberg’s testimony, along with that of her powerful ex-husband, could shed light on how the county’s top law enforcement officer does his job and urged the judge to reverse course.
“To the extent that the testimony of either witness may imply Mr. Aronberg’s professional duties or actions that reflect his suitability as a prosecutor, transparency is of the utmost public importance,” newspaper attorneys Dana McElroy and Mark Caramanica wrote.
They allege that Broward County Circuit Court Judge Timothy Bailey failed to take the proper steps before ordering that Lynn Aronberg’s testimony remain barred from the public. They also allege Bailey failed to justify why he felt it was necessary to put on a muzzle, preventing defense attorneys, prosecutors and others from speaking out on the case.
Rancor marks the exchange between attorneys for Straub, Aronberg
Palm Beach County Attorney Dave Aronberg, his then-future wife Lynn Lewis, Lorenzo Borghese, Jessica Nicodemo and Glenn Straub at a 2015 charity event at the Palm Beach Polo for Nicodemo’s pet rescue group.
Typically, such requests are made by defense attorneys who do not want pre-trial publicity to deprive their clients of fair trials. In Straub’s case, however, the restrictions were requested by prosecutors.
In fact, Straub’s lawyers have joined the newspapers in demanding that the restrictions be lifted. They also asked Bailey to coerce a reluctant Aronberg into answering their questions.
Illustrating the resentment surrounding the case, Straub’s attorneys accused Aronberg of lying in court filings to try to avoid their questions. To avoid a scheduled interrogation, Aronberg submitted an affidavit claiming he had no information to offer.
Defense attorneys Michael Gottlieb and Larry Zink wrote that Aronberg’s testimony was “false, misleading, misrepresented and failed to disclose numerous relevant and significant facts important to the defense of Defendant Straub.”
In response, a Palm Beach County assistant district attorney snapped back.
In a motion to block Aronberg’s testimony, prosecutor Leigh Miller accused Gottlieb and Zink of making “constant and unfounded remarks.” She insisted that her “energetic but offensive effort” was aimed at slandering Aronberg in order to divert attention from Straub.
Why Miller filed the motion on behalf of her boss instead of a Broward County prosecutor is unclear. The case is being handled by a Broward judge and Broward County prosecutors because of its high-profile cast of Palm Beach County characters, including Aronberg and Straub.
Palm Beach and Broward County prosecutors spokesmen declined to comment on why Broward County prosecutors did not file the motion on Aronberg’s behalf. Both said they could not talk about pending cases. But legal experts say such requests are usually handled by prosecutors involved in the case.
Straub, Aronberg were friendly before investigations, separations

The charge against Straub was a potentially thorny issue for Aronberg from the start.
The 75-year-old polo-loving Straub, a well-known and controversial figure in Wellington and beyond, is accused of posting $77,380 in false liens on homes owned by his former girlfriend Jessica Nicodemo. Prosecutors allege Straub filed the liens to punish 38-year-old Nicodemo for breaking up with him.
Before the separation and before the Aronbergs’ almost two-year marriage broke up in 2017, the couples were friends. They have been seen together at charity events.
In a statement, Nicodemo described Lynn Aronberg as her best friend. She introduced Dave and Lynn, and later, when the Aronbergs’ marriage fell apart, Nicodemo said she served as her unofficial “matchmaker.” Lynn slept on Nicodemo’s couch hundreds of times while waiting for her divorce to become final in August 2017.
While Aronberg insists he did not take part in the investigation that led to an indictment against Straub, Gottlieb and Zink said evidence suggests otherwise.
In testimony in a civil lawsuit Straub filed against Nicodemo, Lynn Aronberg said she spoke to Brian Fernandes, Aronberg’s chief assistant at the time, about her friend’s allegations, Gottlieb wrote. Phone records show they also exchanged texts.
Aronberg also called Nicodemo and exchanged texts, Gottlieb said.
In the affidavit, Aronberg said when he spoke to Nicodemo, it wasn’t about her allegations against Straub.
“As I always explain to anyone who asks similar questions, I have told Ms Nicodemo that if she believes a crime has taken place, she must speak to her local law enforcement agency,” he wrote.
“Whatever happens in a courtroom directly or indirectly affects the public at large”
With wildly different claims swirling around the case, the public deserves a full picture of how it unfolded, the newspaper’s lawyers said. Additionally, county residents need to know what Lynn Aronberg said when questioned about her politically powerful ex-husband.
Neither will happen if the restrictions are not lifted, the lawyers wrote.
“This case concerns matters of high public interest related to criminal charges against a prominent local businessman and also concerns the prosecutor,” they said.
State and federal courts have consistently ruled that court records and proceedings should be open to the public, they said.
“Whatever happens in a courtroom directly or indirectly affects the public at large,” they wrote, citing a 1977 Florida Supreme Court decision to have.”

Dave Aronberg (born May 4, 1971) is the prosecutor for Palm Beach County, Florida and a former member of the Florida Senate. He was elected the youngest member of the Senate in 2002 and served eight years. He is a Democrat.[3]
Prior to serving in the Senate, Aronberg practiced law in both the public and private sectors. He was serving as Florida Attorney General’s “drug czar” in 2012 when he announced his candidacy for Palm Beach County Attorney General.[4] He was first elected to office in November 2012 and re-elected unopposed on May 6, 2016.[5][6]
Early life and career[edit]
Aronberg was born in Miami. He attended North Miami Senior High School and graduated from Harvard College in 1993 with a Bachelor of Arts with honors in government. He then attended Harvard Law School, where he received a Juris Doctor with honors in 1996.
After graduating, Aronberg spent three years in the litigation department of the law firm Steel Hector & Davis LLP in Miami and West Palm Beach.[7]
Relief of the Holocaust victim insurance
Aronberg took a three-month leave of absence from the law firm in 1998 to work for US Senator Bill Nelson, who was serving as Florida’s insurance commissioner at the time.[7] Nelson and Aronberg worked together to investigate European insurance companies that refused to recognize World War II-era policies sold to victims of the Holocaust.[3] In cooperation with members of the National Association of Insurance Commissioners (NAIC), the investigation led to the formation of the International Commission on Holocaust Era Insurance Claims (ICHEIC) and the passage of Florida’s Holocaust Victims Assistance Act to ensure that insurance claims are made by Holocaust victims be quickly identified and properly paid for, compensated for, or returned.[8][9]

Aronberg served on two separate occasions as Assistant Attorney General in the Florida Attorney’s Office of the White Collar Crimes Division. In 2000, President Bill Clinton elected Aronberg a Fellow of the White House. After completing the fellowship in September 2001, Aronberg returned to the white-collar crime unit.[10]

Aronberg investigated late-night TV celebrity Youree Harris, a/k/a “Miss Cleo,” and the Psychic Readers Network for deceptive marketing practices.[11] As part of the investigation, Aronberg obtained a copy of Harris’ California birth certificate and released it, even though she was promoted as a shaman from Jamaica.[12] The Federal Trade Commission, working with Florida and other states, fined the Psychic Readers Network $5 million and forced it to cancel $500 million in customer bills.[13]
White House Fellowship[ edit ]
In 2000, Aronberg was selected as one of 15 White House Fellows from across the country. In this bipartisan position, he served in two presidential administrations as the Secretary of the Treasury’s special assistant on international money laundering, including terrorist money laundering.[14]
He was part of a US delegation to an international summit on money laundering at an Asia-Pacific Economic Cooperation (APEC) conference in Kuala Lumpur, Malaysia in 2001.[15]
Florida Senate[edit]
Aronberg was elected the youngest member of the Florida Senate in 2002.[3] He served as Chairman of the Committee on Military Affairs and Homeland Security and Chairman of the Everglades Restoration Committee, where he advocated for additional state and federal funding to protect and restore the River of Grass.
State Security[ edit ]
As chairman of the Florida Senate Committee on Military Affairs and Homeland Security, Aronberg led a rewrite of Florida’s Port Security Act to better protect Florida residents from terrorist threats. Aronberg’s 2009 bill, signed by Florida Gov. Charlie Crist at a signing ceremony in Port Everglades, Fort Lauderdale, brought Florida’s security law into line with federal requirements.[16] The bill received unanimous support from labor unions and maritime companies, resulting in the Maritime Council of the Associated Industries of Florida naming Aronberg “Legislator of the Year” for his work improving port security, while expanding Florida’s global position as a leading exporter.[ 17]

Opioid abuse[ edit ]
When Aronberg was elected to the Florida Senate in 2002, he followed up on his Purdue Pharma investigation by drawing attention to the growing opioid crisis. In 2010, the Florida legislature enacted a law co-sponsored by Aronberg to regulate the pain clinic industry and limit the sale of narcotics such as oxycodone.[18]
In 2007 he managed to pass an anti-looting law that increased penalties for certain thefts and burglaries committed after the governor declared a state of emergency.[19][20]
Gang violence[ edit ]
In 2007 and 2008, Aronberg urged the legislature to pass tough anti-gang laws. The language in Aronberg’s proposal, which went into effect in 2008, increased penalties for common offenders convicted of gang crimes and toughened penalties for witness tampering and harassment. The legislation also prohibited gang members from wearing bulletproof vests while committing a crime.[21]
Sexual violence[edit]
Aronberg sponsored a bill to abolish the statute of limitations for child victims of sexual abuse. His bill, SB 870, was passed unanimously by both the House and Senate and signed by Governor Crist.[22] The Florida Coalition Against Sexual Violence named Aronberg its 2010 Legislator of the Year.[23]

Palm Beach County Attorney
In January 2012, Aronberg announced his candidacy for Palm Beach County Attorney.[30] Aronberg won the office with 58% of the votes in the November 6, 2012 elections and was re-elected unopposed on May 6, 2016.[31]
As a prosecutor, Aronberg leads a team of 120 prosecutors and 220 professional associates in five offices throughout Palm Beach County.[32]
In 2016, Aronberg was elected an officer of the National District Attorneys Association (NDAA) and subsequently re-elected in 2017.[33] He led an NDAA working group that released a national report to advise prosecutors and legislators on best practice in dealing with the opioid epidemic.[34] In November 2016, Aronberg traveled to the Guantánamo Bay Naval Base as a representative of the NDAA to observe the pursuit of indicted al-Qaeda terrorist Abdul al Hadi al Iraqi.[35] In 2016, Florida Bar President Bill Schifino appointed Aronberg to the Board of Governors of the Florida Bar to represent government attorneys statewide. Aronberg was reappointed to two more terms by Florida Attorney Generals Michael Higer and Michelle Suskauer.[36]

Sober Homes Task Force[edit]
Aronberg’s most notable task force is his Sober Homes Task Force, which has helped solve fraud and abuse in Palm Beach County’s drug reclamation industry, also known as “The Florida Shuffle.”[38] Since October 2016, the task force has made more than 85 arrests for patient referrals and insurance fraud, leading to new laws and regulations in Florida that have become a model for other states.[39][40] Aronberg’s efforts also persuaded Google to limit advertising and improve searches for addiction treatments.[41] The crackdown on sober households and corrupt drug treatment resulted in an approximately 40% decrease in opioid overdose deaths in Palm Beach County in 2018 compared to 2017.[42] Aronberg’s task force has received national attention for its work tackling the opioid epidemic, including a Sunday night feature story with Megyn Kelly on June 25, 2017 and a 60-minute interview on September 30, 2018.[43][ 44] After testifying twice before Congress about federal legislation unwittingly favoring drug relapse over recovery, Aronberg launched a website to urge policymakers to “fix the Florida Shuffle.”[40]
Human Trafficking Task Force[ edit ]
In 2017, Aronberg formed a human trafficking task force with the Palm Beach County Sheriff’s Office and federal officials. The Florida Attorney General appointed Aronberg to the Statewide Council on Human Trafficking to represent all prosecutors.[45][46]
Animal Welfare [edit]
Aronberg, who adopted his Basset Cookie from Big Dog Ranch Rescue in 2011, personally prosecuted an animal cruelty case in his first trial as a prosecutor.[47]
In recognition of his efforts to combat animal cruelty, Aronberg received the Pegasus Foundation’s national Wings Award for his contributions to animal welfare.[48]

Aronberg caught national media attention during the 2016 presidential election when he announced that he would not go down on a battery charge against Corey Lewandowski, Donald Trump’s campaign manager. Jupiter police had charged Lewandowski with assault after former Breitbart reporter Michelle Fields claimed he grabbed her after a March 8 Trump press conference at Trump International Golf Club.[54]
Case of Nouman Raja[ edit ]
As a prosecutor, Aronberg pleaded guilty to involuntary manslaughter and attempted first-degree murder with a firearm against Palm Beach Gardens Police Officer Nouman Raja for the killing of 31-year-old musician and housing inspector Corey Jones, a black man who had been waiting for help on a freeway after his car broke down.[55][56] On March 7, 2019, a jury found Raja guilty as charged, making him the first Florida officer to be convicted of an on-duty shooting in 30 years.[57] District Court Judge Joseph Marx sentenced Raja to 25 years in prison.[58]
