Hannah Tubbs, 26, was serving a two-year sentence at a Los Angeles County juvenile facility when she was arrested there Friday on a second-degree robbery charge, online records show.

Tubbs, born James Edward Tubbs, is being prosecuted under that name in the 2019 robbery, sources told the Post.

Tubbs is being held on $1 million bail at the Kern County Jail in Bakersfield, California, and is scheduled to appear in court Tuesday to face charges, online records show.

Tubbs made headlines in January after pleading guilty to the 2014 assault at a Denny’s restaurant in Palmdale, where prosecutors said the then 17-year-old grabbed a 10-year-old girl and put her hands down her pants in a booth plugged.

Tubbs was arrested in 2019 after she was arrested in Idaho on a battery charge and her DNA matched a national database. She then pleaded guilty to the California sexual assault in November.

A judge ruled that Tubbs would serve her two-year sentence at a juvenile treatment center after Los Angeles District Attorney George Gascón refused to file a motion to move the case to juvenile court, where he filed due to Tubbs’ age at the time became the offense.

Judge Mario Barrera reiterated in court that he could sentence Tubbs to two years because Gascón’s office had not made a request to refer the case to an adult court.

Tubbs then reportedly boasted about her light sentence, prompting Gascón to acknowledge in a statement in late February that the sentence may have been too light.

During detention, Tubbs made rude comments about the girl and boasted that Tubbs now does not have to register as a sex offender, KTTV reported, citing a recorded call to her father.

“Don’t worry about it,” Tubbs told her father of the case. “It’s a strike but they will plead, I will plead with them and plead guilty.”

Gascón’s statement noted Tubbs’ “extremely disturbing” comments about the case and the young girl who had hurt her.

“While several years in prison is appropriate for most people, that may not be the case for Ms. Tubbs,” Gascón said. “If we had known of her disregard for the harm she caused, we would have handled this case differently.”

Gascón’s decision drew the ire of prosecutors in the case and Los Angeles County Superintendent Kathryn Barger, who said the judge’s “hands were tied” during sentencing due to the prosecutor’s inaction.

“Instead, we are left with a 26-year-old individual who was sentenced to two years in isolation in a juvenile facility, separated by sight and sound from the other juveniles,” Los Angeles County Superintendent Kathryn Barger said in January.

Shea Sanna, the assistant district attorney originally assigned to Tubbs’ Los Angeles crime case, said a progress report in April showed Tubbs had about 60 “negative incidents” and was not cooperating with the rehabilitation program she had during her time in The youth facility had to claim.

Sanna said he was taken off the Tubbs case and was told to remain silent about the case.

“Not only did they drop me off, they tried to silence me,” Sanna told The Post on Monday. “The person who replaced me still doesn’t even have the file and they haven’t pulled up any of the progress reports on how (Tubbs) is actually doing. My office knows that (Tubbs) is violent and has no regrets. In fact, the only people doing their job, like me, are punished and face retaliation.”

While facing a Kern County felony case, Tubbs could be released from her Los Angeles case as early as June depending on the outcome of her juvenile detention progress report, Sanna said.

Because her case was filed in Los Angeles juvenile court, Tubbs did not have to register as a sex offender upon her release.

“There are so many ‘what if’ questions and we don’t know what’s going to happen with the Kern County case, but the only thing we can control is giving the judge all the facts so the court can have a can make an informed decision.” Sanna said. “They don’t. DA Gascón and his government know that (Tubbs) is a repeat sex offender and has had other violent crimes.”

Ricardo Santiago, a spokesman for the LA County District Attorney’s Office, said Tubb’s transfer from juvenile facility to the Kern County Jail was based on a 2019 warrant approved by a judge.

“District Attorney George Gascón is committed to protecting the public and our children in particular,” Santiago told the Post on Monday. “In this case, Hannah Tubbs is continuing to serve her sentence in Los Angeles County while she faces prosecution for an unrelated robbery in Kern County. … In the Los Angeles County case, a no-bail warrant has been obtained, so officials here will be notified if she is released from Kern County.”

In one of the calls, Tubbs asks the caller to use feminine pronouns.

“Like any responsible office, we learn as we go, taking feedback from the community and making the necessary adjustments based on our experience and the complexity of this work,” he said, adding that “a small number of cases” a denied requiring flexibility to its prosecutors under its edicts.

“In particular, we learned a lot from the Hannah Tubbs case about the need for a political safety valve,” Gascón said.

He also admitted Tubbs committed other offenses after the 2014 attack – including one where DNA evidence linked her to Denny’s attack.

Then on Friday, in a series of five memos sent to staff, Gascón resigned from his other orders, saying exceptions could be made to retry charges that would carry life sentences without parole and allow juveniles to come forward to prepare adult dishes. He will continue to prevent his office from seeking the death penalty.
